Damages for publishers — supported by initial court rulings
Initial French court rulings confirm publishers’ damages claims (Paris Commercial Court, judgments of 10 March 2026). Two heads of loss are involved:
Lost publisher revenue (+35%) In an undistorted market, publishers would be expected to have earned substantially more from their ad inventory. The Paris Commercial Court quantifies this additional revenue at 35%.
Excessive AdX fee (−5 percentage points) Without Google’s self-preferencing, the resulting stronger competitive pressure would have led to a lower AdX fee. The Paris Commercial Court quantifies this overcharge at 5 percentage points.
